Welcome to Faltara. These Terms of Use ("Terms") govern your access to and use of the Faltara platform available at faltara.com and app.faltara.com ("Platform"). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
These Terms are governed by the laws of the Kingdom of Saudi Arabia, including the Electronic Transactions Law, the Anti-Cyber Crime Law, the Commercial Court Law, and the Personal Data Protection Law (PDPL).
1. Definitions
- "Platform" refers to the Faltara website (faltara.com) and application (app.faltara.com).
- "Company" refers to any organization that posts job openings on the Platform.
- "Recommender" refers to any individual who recommends candidates for job openings.
- "Job Seeker" refers to any individual seeking employment through the Platform.
- "Reward" refers to the monetary compensation paid in Saudi Riyals (SAR) for successful recommendations.
- "User" refers to any Company, Recommender, or Job Seeker using the Platform.
2. Eligibility
- You must be at least 18 years old to use the Platform.
- Companies must be legally registered entities in their operating jurisdiction.
- Companies operating in Saudi Arabia must comply with Nitaqat (Saudization) regulations.
- You must provide accurate and truthful information when creating an account.
3. Account Registration
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access at support@faltara.com.
4. Platform Services
Faltara provides the following services:
- For Companies: Post job openings, set rewards, receive recommended candidates, and manage hiring.
- For Recommenders: Browse open roles, submit candidate recommendations, and earn rewards in SAR upon successful hires.
- For Job Seekers: Create profiles, get discovered by companies, and receive recommendations from trusted professionals.
Faltara is a technology platform, not a recruitment agency. We facilitate connections but do not guarantee employment outcomes.
5. Rewards and Payments
- All rewards are denominated and paid in Saudi Riyals (SAR).
- Rewards are paid only upon confirmed successful hiring as defined in the job posting terms.
- Payment processing is subject to applicable Saudi financial regulations.
- Users are solely responsible for any tax obligations arising from rewards received.
- Faltara reserves the right to withhold rewards in cases of fraud, misrepresentation, or Terms violations.
6. User Obligations
All users agree to:
- Provide accurate, truthful, and up-to-date information.
- Not engage in fraudulent, misleading, or deceptive practices.
- Not post discriminatory content violating Saudi labor laws.
- Respect intellectual property rights of Faltara and other users.
- Not attempt to circumvent the Platform to arrange direct hiring and avoid reward payments.
- Comply with all applicable laws of the Kingdom of Saudi Arabia.
7. Prohibited Activities
- Submitting fake recommendations or falsified candidate information.
- Creating multiple accounts to manipulate the system.
- Scraping, automated data collection, or reverse-engineering the Platform.
- Uploading malicious code, viruses, or harmful content.
- Harassment, discrimination, or any behavior violating Saudi public morality and decency laws.
- Any activity that violates the Saudi Anti-Cyber Crime Law.
8. Intellectual Property
All content, designs, logos, software, and materials on the Platform are owned by Faltara or licensed to us. You may not copy, modify, distribute, or create derivative works without our written consent. Content you submit (profiles, recommendations) remains yours, but you grant Faltara a non-exclusive license to use it for platform operations.
9. Limitation of Liability
To the maximum extent permitted by Saudi law:
- Faltara is not liable for the accuracy of information provided by users.
- We do not guarantee any specific hiring outcomes or recommendation results.
- We are not responsible for disputes between companies, recommenders, and job seekers.
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Faltara harmless from any claims, damages, or losses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
11. Termination
Either party may terminate the account at any time. Faltara reserves the right to suspend or terminate accounts that violate these Terms without prior notice. Upon termination, your right to use the Platform ceases immediately. Accrued payment obligations survive termination.
12. Dispute Resolution
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts in Riyadh, Kingdom of Saudi Arabia.
13. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after modifications constitutes acceptance. If you disagree with changes, you must stop using the Platform.
14. Severability
If any provision of these Terms is found invalid or unenforceable by a Saudi court, the remaining provisions shall continue in full force and effect.
